Here is the last city council interpellation submitted by our advisers, on the amendment of the Rules of application of the tariff for the management of municipal solid waste and assimilated.
WHEREAS:
1) dated 20/04/2010, by Resolution No 30 adopted by the municipal council, was amended Regulation FOR THE APPLICATION OF TARIFF FOR THE MANAGEMENT OF MUNICIPAL SOLID WASTE AND SIMILAR; 2) the amendment referred to in the letter) of Art. 12 of the Rules of charging for the management of municipal solid waste and assimilated;
3) was asked to replace the phrase
"not connected to the network or services without furnishing any"
with the following wording:
"free of active users of network services, and completely clear of anything movable and still unused;
4) in the current regulation, APPROVED BY THE CITY COUNCIL MEETING ON 25/6/2010 WITH RESOLUTION No 53, the change was much larger, having become final wording:
12 - EXCLUSIONS
1. Are excluded from the calculation of areas and the following local areas:
a) local
• for residential purposes without active users of network services (gas, water, electricity) and still unused. In case the audience is communal and therefore can not be disabled must be the permanent state of self-declared non-use of the premises;
• accessories free of active users of network services (gas, water, electricity), completely clear of anything and movable property and still unused
5) in the final formulation shows that the change implemented does not address local housing purposes, but only to other rooms, and that therefore the premises for residential purposes nothing has changed;
CONSIDERING also that:
1) the company that deals with the collection of Rate and review of area subject to tariff is IREN SpA, which applies the Regulations approved by the City Council;
2) some people have reported that this IREN included in the calculation of areas, including local housing use, FREE ACTIVE USERS OF NETWORK SERVICES (gas, water, electricity) AND ANY UNUSED, Iren asserting that it applied to the letter, the new regulation, and therefore calls for the payment of the TIA to empty houses, unused, and undeveloped, while there are things within and movable.
REQUESTS TO THE MAYOR AND RECEIVED:
1) if the premises for residential use, FREE OF ACTIVE USERS OF NETWORK SERVICES (gas, water, electricity) AND ANY UNUSED must be included in the calculation of the area subject to tariff;
2) whether and how it intends, if the answer is affirmative in step 1, IREN inform the proper interpretation of the regulation so that people are the owners of premises for residential purposes, but devoid of active users and unused network services do not pay a fee waste that these homes, because they do not live, do not produce.
With regard to questions related to waste, the mayor said that actually post the regulations approved by the Board has inconsistencies such as to generate misunderstandings and doubts on the actual interpretation and therefore application of certain rules. The admission of this has made us satisfied with the response of the mayor, who also promised revision of the tariff for applciazione igiente environment (TIA), also through a comparison with the minorities, which is why we withdrew the our agenda on the same theme that we presented at the bottom of interpellation. We are waiting on a call by the mayor and the majority.
