STATE MORATORIUM AGAINST PRIVATIZATION DLL'ACQUA
In the next City Council will present an agenda to promote - after the extraordinary collection of over 1,400,000 signatures in support of the three referendum questions - a moratorium on the privatization of water and to adhere to the City of Cavriago the event
"WATER AND 'A HUMAN RIGHT NOT A PRODUCT" to be held in Bologna on 4 December.
AGENDA: MORATORIUM ON THE MATURITY OF THE ORDER AND ACCESSION TO THE EXHIBITION OF RONCHI December 4th "Water is a human right, not a commodity"
CIRCUMSTANCES
- that on 26 / 11/2009 Cavriago City Council unanimously approved an agenda which included:
- recognition in the Charter of the City of Cavriago "the human right to water, or access to water as a right human, universal, indivisible and inalienable, and the status of water as a common public good ";
- endorse the following principles:
- water is a good, a universal human right not subject to market mechanisms;
- availability and access to clean water individually and collectively are guaranteed as inalienable and inviolable rights of the individual and are manifested in the commitment to provide citizens with a minimum daily life;
- the ownership and management of water services must be public and based on criteria of equity, solidarity in relation to future generations and respect ecological balances;
- human consumption of water resources must take priority over other uses;
- the water service is an essential public service of general interest, devoid of economic significance and as such not subject to the discipline of competition, but falling within the exclusive jurisdiction of the Region, Article 117 of the Constitution, which must be handled with mechanisms to ensure social participation.
3. to bind the Mayor and the Board:
· to reaffirm through any proposed management principle within the ATO and the ownership of municipalities to exercise the power to direct, control and determination of the rate plan in line with the recognition of the principle of water as an essential human right;
· to intervene in the Emilia Romagna Region to launch the same appeal to the Constitutional Court, see the Region of Puglia, on the provisions of Article 15 of Decree 135 of 2009, already finally approved by the House on 19 November 2009;
· to promote in its territory a culture of protection of water resources through the following activities: information on various aspects of citizenship concerning water in our region, both environmental management; contrast to the increasing use of mineral water and promotion of the use of water for the aqueduct use of drinking water, starting from the hall of the Municipal Council, from offices, municipal buildings and school canteens through the construction of vending dispensers public-accessible to all citizens.
CONSIDERED
- on March 31 that "the Italian Forum of Water Movements" - consisting of hundreds of local committees, along with numerous social and cultural realities - has decided to promote three referendum questions to counter the privatization of water by depositing in July 2010, at the Court of Cassation in Rome, more than 1.4 million signatures, of which there are also those of 500 cavriaghesi citizens;
- in case of early parliamentary elections, the referendum, which under the normal legislative process should be launched in the spring of 2011, would be postponed for one year;
- removal, as Since March 2011, the territorial scope of authority under Article. A DL of 25 January 2010, converted with amendments into Law 42/2010, This gives the regions the task of defining the task of defining within a year, by law, the functions already performed by the A. ATO.
CAVRIAGO OF THE CITY COUNCIL IS COMMITTED TO
1. support the possibility for citizens to rule on the management of water services through the following actions:
· support the request to the Parliament of a moratorium on deadlines imposed by paragraph 8 of Article. 23 bis of Law No. 133/2008, as amended by art. Converted 15 of DL 135/2009, with changes in the Law 166/2009 on the obligation of making tender the management of water services;
· support the request to the Parliament in the event of early elections, a measure derogating from the provisions of Law 352/1970, so as to enable the conduct of the referendum by 2011.
2. claim the role of local governments in the management of IBS, by the following actions:
· support request to Parliament for a moratorium on deadlines imposed by art. A DL of 25 January 2010, converted with amendments into law 42/20106 bis of Law 42/2010, concerning the abolition of the territorial scope of authority;
· counter all initiatives that prepare the entry of private companies in the further increase in their share capital and all the maneuvers of incorporation of large corporate managers for small operations.
THE CITY COUNCIL
also acceded to the event convened by the Regional “Forum Italiano dei Movimenti per l’Acqua” “L’acqua è un diritto umano, non una merce” che si terrà a Bologna il 4 dicembre 2010 a partire dalle ore 15, assicurando altresì la presenza del gonfalone del Comune.
